There is a law about this dispute resolution system called the Education (Domestic Tertiary Student Contract Dispute Resolution Scheme) Rules 2021

We have been appointed by the Minister for Education as the operator of the dispute resolution scheme under s 536 of the Education and Training Act 2020.

The legal rules that govern our process are set out in the Education (Domestic Tertiary Student Contract Dispute Resolution Scheme) Rules 2021. These set out the process that everyone involved must follow.

Enforcing outcomes of our dispute resolution services

Both Learners and Tertiary Education Providers have to comply with the outcome of the process. This means that any agreement reached through Talk – Meet – Resolve and any decision made by the independent person through Listen – Decide is binding on everyone involved. These can be enforced by the District Court  which also has a discretion to modify any resolution before giving effect to it.
